Terms and Conditions of Services
1. General Provisions
1.1. This agreement (the "Agreement") governs the relationship between the CryptoPulse.exchange service (the "Service") and users of the CryptoPulse.exchange website (the "User"). By using the CryptoPulse.exchange website or performing any actions related to currency exchange on the Service pages, the User confirms acceptance of these terms. If you do not agree with the rules below, use of the Service is not permitted.
1.2. By using the Service, you confirm and agree that:
you have the legal capacity and age required to accept this Agreement;
your right to use the Service has not previously been suspended or prohibited.
2. Terms and Definitions Used in the Agreement
2.1. CryptoPulse.exchange (the "Service") is an online platform located at cryptopulse.exchange on the Internet and providing exchange services for digital and electronic currency.
2.2. The User is any individual who wishes to use the services of CryptoPulse.exchange and has accepted all terms of this Agreement.
2.3. Digital currency means any currency or other cryptographic or encryption-based asset used in accordance with applicable requirements.
2.4. Electronic currency means funds held in user accounts within payment services.
2.5. Funds means digital and/or electronic currency.
2.6. Payment system means a product created by third parties that provides rules, procedures, and technical infrastructure for the transfer of value between economic actors.
2.7. Payment means a transfer of electronic and/or digital currency from the payer to the recipient.
2.8. Order means the User's intention to use the services of CryptoPulse.exchange by filling out the electronic form on the website under the terms described in this Agreement and in the conditions of the relevant request.
2.9. Parties means the User and CryptoPulse.exchange together.
2.10. Currency exchange means exchanging digital or electronic currency of one payment system for digital or electronic currency of another payment system.
2.11. Rate means the value ratio between two assets.
2.12. Currency reserves means the amount of digital financial assets and funds currently available to the Service to perform services. Reserve information is indicated on the main page of the Service website.
2.13. Requisites means the set of details required to make a non-cash payment and credit or debit electronic and/or digital currency.
2.14. Resulting currency means the electronic currency received by the User as a result of selling or exchanging the source currency.
2.15. Currency reserve means the available amount of a specific electronic currency in the CryptoPulse.exchange service at the time an Order is created.
2.16. Service website means cryptopulse.exchange.
3. Entry into Force
3.1. At the moment the User starts creating an Order, the User automatically accepts this Agreement as a public offer.
3.2. Any information displayed by the Service on the website, including during Order creation, forms part of the public offer.
3.3. The Service automatically records the time, rate, and exchange direction associated with the Order.
3.4. This Agreement is published on the Service website. Changes may be made without prior notice to the User.
3.5. After the User receives funds under the Order in full, the obligations arising from the relevant Order are terminated.
4. Subject Matter
4.1. This Agreement establishes the procedure for providing exchange services through Order forms and other services available on the Service website.
4.2. The Service has the right to regulate exchange rates by publishing current information on the Service website.
4.3. An Order created by the User contains the exchange direction, date and time, and the amount of digital and/or electronic currency to be transferred under the exchange.
5. Procedure for Providing Services
5.1. CryptoPulse.exchange provides exchange services through Order forms available on the Service website.
5.2. The Service charges a commission for exchange services. The Service fee is deducted from the Resulting Currency and is indicated in the Order.
5.3. CryptoPulse.exchange determines exchange rates independently and publishes them on the website.
5.4. The Service maintains reserves and operational limits. Information about available reserves and limits is published on the Service website.
5.5. The Service does not guarantee the legality of the User's possession of electronic and/or digital currency involved in a specific Order beyond the compliance procedures applied by the Service.
5.6. The User confirms that the funds and the cryptocurrency address from which the funds were sent belong to the User on lawful grounds.
5.7. After the Service completes an Order and the User receives the funds, the Order cannot be cancelled and no refund request is applicable.
5.8. If the User provides incorrect payment details and funds are sent using such incorrect details, the Order is considered completed and the Service is not liable for that error.
5.9. If the User does not pay for the Order within 30 minutes from the moment it was created, the Service may terminate the agreement unilaterally.
5.10. If funds arrive after the time specified above and the agreement has already been terminated, the funds will be returned to the User minus transfer fees, if any. If delays occur for reasons beyond the Service's control, the refund period may be extended depending on the circumstances.
5.11. If the amount received by the Service differs from the amount specified in the Order, the Service recalculates the exchange based on the funds actually received. If the deviation exceeds 10%, the Service may terminate the agreement unilaterally and return the funds to the User minus transfer fees.
5.12. If the User does not receive the funds due under the Order within 12 hours from creation, the User may request cancellation and refund.
5.13. If the funds have already been sent to the User, the Order cannot be cancelled.
5.14. In the event of Order cancellation, the refund is made within 12 hours from the moment of cancellation. If the Order is cancelled for reasons not attributable to the Service, the User undertakes to pay all commission-related expenses.
5.15. The Service has the right to cancel an Order and return the funds to the User, with commission withheld, without giving reasons.
5.16. Any violation of the rules by the User entitles the Service to terminate this Agreement unilaterally and refuse service.
5.17. After the Service refuses service to a User, the User's other Orders may be frozen pending review.
5.18. The Service has the right to request documents confirming payment, as well as verification where funds are blocked under the AML/KYC policy. If the User refuses to provide proof of payment or refuses verification, the Service may terminate the agreement unilaterally without refund.
5.19. Any funds sent to the Service address and left unclaimed for 14 days are considered lost. Search and refund of such transfers are impossible.
5.20. If the User specifies incorrect requisites, the User has 30 days from the moment the Order is created to correct them by contacting the Service through any available channel.
5.21. If the amount received from the User differs from the amount specified in the Order, CryptoPulse.exchange may recalculate and process the Order without additional notice.
5.22. All taxes related to digital and/or electronic currency received from the Service are paid by the User independently.
5.23. When the User sends Bitcoin, the Service starts completing the Order only after one network confirmation.
5.24. The Service may require the User to create a new Order if the digital and/or electronic currency sent by the User reaches the Service later than 30 minutes after the Order was created.
5.25. The Service must not be used for unlawful transactions. The User accepts possible liability for exchanging suspicious funds under the laws of the relevant jurisdiction.
5.26. If a fraudulent or unlawful payment is proven, the Service may disclose information about it to competent authorities, payment systems, or affected parties.
5.27. If a transaction is identified as high-risk, the Service may suspend the exchange operation until checks are completed in accordance with FATF standards.
5.28. For transactions in the WebMoney direction, the Service may freeze an Order for 24 to 48 hours to verify the payment.
5.29. CryptoPulse.exchange does not work with, send funds to, or accept funds from so-called shadow platforms that violate or may violate Ukrainian law. If such interaction is detected, funds may be frozen, the client may be blocked, and data may be transferred to competent authorities.
6. Liability of the Parties
6.1. The Service operates 24/7, but does not guarantee uninterrupted operation in the event of technical failures, natural disasters, outages, or force majeure. The Service is not liable for user losses caused by the unavailability of the website.
6.2. The Service provides no additional warranties; all conditions and descriptions are published on the website.
6.3. The Service is responsible for funds entrusted to it by the User within the limits of this Agreement.
6.4. The Service is not liable for errors, failures, or other issues occurring on the side of payment systems, including any resulting losses to the User.
6.5. If the Service suffers damage as a result of User actions, the User undertakes to compensate the relevant losses.
6.6. The User undertakes not to interfere with the software code, hardware, or any other systems supporting operation of the Service. Otherwise, the Service reserves the right to contact competent authorities.
6.7. If the Service suspects the User of negatively affecting the operation of the Service, all Orders of that User may be frozen.
6.8. The Parties are released from liability for delay or non-performance of an Order caused by force majeure.
6.9. Citizens and tax residents of the United States are not served by the Service. Any Orders created in circumvention of this clause will be cancelled.
6.10. The website does not support crediting foreign currency to accounts of currency residents of the Russian Federation.
7. Dispute Resolution Procedure
7.1. All disputes and disagreements arising from or in connection with this Agreement shall be resolved through the following channels:
- via operator chat on the Service website;
- via the email address specified in the "Contacts" section of the Service website.
After receiving a claim from the User, CryptoPulse.exchange must either confirm the stated demands within 24 hours or send the User a reasoned refusal.
8. Final Provisions
8.1. CryptoPulse.exchange has the right to send the User information about exchange statuses and Order updates to the email address specified in the Order, as this forms part of the Order process.
8.2. All information published on the CryptoPulse.exchange website, including graphics, text, software code, and other materials, is the property of the Service and is protected by law.
8.3. This Agreement was published on February 11, 2025 and may be updated by the Service unilaterally.
